EEOC Will Not Seek to Collect EEO-1 Pay Data Next Year -- But Employers Must Still Submit 2017 and 2018 Data by September 30

EEO-1 filers must submit EEO-1 Component 2 (compensation and hours worked) data for years 2017 and 2018 by the deadline of September 30, 2019. However, on September 12, 2019, the EEOC announced that it does not intend to require EEO-1 filers to submit compensation data next year. The EEOC intends to collect only Component 1 data (which includes gender and race but does not include compensation information) for the upcoming three years.

The EEOC stated that after re-evaluating the burden to employers to submit the required pay data, and determining that the costs are significantly higher than previously estimated, it will consider future compensation data collection efforts after evaluating the value of the data it receives in this year’s collection.

The EEOC is accepting public comments on its intended plan through November 12, 2019. Employers should consult with experienced employment counsel if they have any questions about the EEOC’s announcement or need assistance with completing their 2017 and 2018 Component 2 reports.
