Jury Awards Patentee Nine-Figure Patent Damages Award

A New Jersey jury has awarded Eagle View Technology $125 million in patent damages. Eagle View originally sued its competitor Verisk and its subsidiary corporation Xactware, for infringing nine patents related to software for developing 3D models from aerial images. Eagle View competes with Verisk and Xactware in the construction and insurance markets, to create accurate roof reports for estimating repair costs. Over the course of the litigation, Eagle View narrowed its case and survived Inter Partes Review. Following trial, the jury found that Verisk and Xactware infringed Eagle View’s patents and awarded Eagle View $125 million in lost profit damages. The Court immediately entered a temporary restraining order, pending a hearing on a permanent injunction in early October.
