Since last week, when a Federal District Court in Florida struck down the Center for Disease Control’s Mask Mandate for public transportation, many local jurisdictions have announced an end to mask mandates.  Indeed, the California Department of Public Health (CDPH) removed transportation and transportation hubs from California’s Mask Mandate which previously had relied on the CDC’s order. 

However, as we noted last week, the Los Angeles County Public Health Order (LACPHO) did not rely on CDPH or CDC guidance and, as of March 23, 2022, required masks on public transportation and in transportation hubs.  LACPHO amended its order to clarify that masking continues to be required in all public transit in its jurisdiction, including commuter trains, subways, buses, taxis, and ride shares and at airports and other transportation hubs.

It should also be noted that last week, the Department of Justice appealed the Florida District Court’s ruling to the 11th Circuit Court of Appeals.  We will continue to monitor and post about the status of the various mask mandates for California employers.
