Oral argument has been scheduled in two cases that will address whether Title VII prohibits discrimination based on sexual orientation or gender identity.

The U.S. Supreme Court will hear arguments on Tuesday, October 8, in the consolidated case of Bostock v. Clayton County/Altitude Express v. Zarda (sexual orientation) and R.G. & G.R. Harris Funeral Homes v. EEOC (gender identity).

In Bostock, the U.S. Court of Appeals for the Eleventh Circuit ruled that sexual orientation discrimination was not prohibited by Title VII. In Altitude Express, the U.S. Court of Appeals for the Second Circuit ruled that it was.

In R.G. & G.R., the U.S. Court of Appeals for the Sixth Circuit ruled that gender identity discrimination violated Title VII.
