2023 saw a continued uptick in privacy litigation filings throughout the United States, with Plaintiffs counsel taking aim at cookies, session replay, video URLs, online “doxing” and the use of other online tracking technologies to collect and share consumer information. While the volume of cases filed under the federal Video Privacy Protection Act (VPPA) and Wiretap Act, California Invasion of Privacy Act (CIPA) and other state laws continue to grow, another phenomenon has emerged: mass arbitration demands. Pursuing arbitration can force businesses to pay hundreds of thousands of dollars upfront in filing and case management fees and arbitrator fees, before the merits of the demand can even be challenged. This webinar will explore privacy litigation trends and strategies for defending against mass arbitration consumer privacy demands.
