Many wonder when they should hire a lawyer in the months and weeks before a divorce or family law matter. “Should I do it now? Can I wait until later?” Questions like these are typical.

As a divorce or family law matter looms, many are in a quasi-state of denial. They often wrongly think that the situation can be averted.

Sometimes, cooler heads can prevail, and a divorce or family law matter can be avoided. But often, it cannot and will happen, whether somebody desires it or not.

When Is The Best Time To Hire A Lawyer?

When somebody is unsure whether to hire a lawyer, it can confuse many individuals. They often worry that if they hire a lawyer first, they are setting off the divorce or family law litigation. Many also fear that their spouse, or the other party, will find out they have hired a lawyer first. The concern can be that this sets off litigation.

While these thoughts go through somebody’s head, they should not be at the forefront. The truth is that if a person thinks they need a lawyer, the situation is probably bad. If the situation is bad, they probably need a lawyer now.

Ultimately, most should get a lawyer if they think they need one. Often, in the weeks or months leading up to divorce or family law litigation, significant events happen that can affect the outcome of the case.

There could be phone calls and text messages. If the parties are still in the same home, arguments and bickering could occur. If a party behaves badly in these situations, the case outcome can be impacted.

Even the most calm and level-headed individuals need a lawyer to talk to during difficult times and get advice and input. Without hiring a lawyer, many are left to flounder, stress, and make mistakes that worsen their cases.

What If I End Up Not Needing a Lawyer?

If the divorce or family law case can be averted, that can be a positive outcome. In that situation, the individual can ask for the balance, deposit, or retainer to be returned to them.

There really is no harm in hiring a lawyer and not needing one in the end. On the other hand, if somebody needs a lawyer and does not get one, there is a risk of harm.
