Last week, a White House memorandum implemented President Biden’s executive order reversing former President Trump’s executive order on diversity training. Notably, both orders only applied to federal agencies, federal contractors and recipients of federal funds – not to the general private sector.

Federal agencies, contractors and fund recipients are now permitted to utilize diversity training the same as before former President Trump’s order. To the extent government contracts used former President Trump’s prohibitions on diversity training, those contract provisions will not be enforced. In addition, the hotline for reporting violations is shutdown because there can no longer be violations of former President Trump’s orders.
