9th Circuit debates “Blurred Lines” verdict

Bill Hochberg was quoted in a Daily Journal article about the “Blurred Lines” case currently on appeal before the 9th Circuit. At the hearing held October 6th, the three judges appeared to be skeptical about overturning the district court's previous judgment which handed down a $5.3 million punishment against Robin Thicke and Pharrell Williams for copying Marvin Gaye's "Got to Give It Up" to create "Blurred Lines."

The case is an important one for the industry and has raised many questions on what elements of a song are protected. Hochberg noted that since the “Blurred Lines” verdict many composers have a lot of paranoia about accusations of copyright infringement. 

“I hope that a bright-line replaces the blurred one with a decision that helps guide creative people in the music industry, so they don’t have to be paranoid that the music flowing through them might have been inspired by someone else,” Hochberg said.
