The Nelson Mullins 2023 Value Based Care Conference: Implementing Value Based Strategies, was held on November 2, 2023, at the Tower Club in Fort Lauderdale. By any definition, the event, which has become an annual “can’t miss” offering, must be rated as a rousing success.

The attendees, who participated both in person and virtually, were given presentations by industry leaders. They provide a multi-faceted view of strategies for value-based care, and the use of value-based enterprises as a strategy for operations to overcome Stark Law and anti-kickback issues.

Juliette Price of Helgerson Consulting Group was the keynote speaker for the second year in a row. She discussed the state of value-based care and the future of risk-based arrangements. She made very clear that they are the wave of the future. Health care providers must understand and appreciate opportunities to engage in value-based care and risk. To do so requires significant planning and teamwork, and reasonable reimbursement strategies. Value based care is not going away; it will continue to expand. It is also not for the faint at heart.

There were four panel discussions. The first, moderated by Gabe Imperato of Nelson Mullins, was titled “Using a Value-Based Enterprise as a Strategy.” The panelists included Nelson Mullins partners Ed White and Mike Segal, and Dr. Jeffery J. Thramann, the Chairman and CEO of Colorado-based Influence Healthcare, LLC. Ed White and Mike Segal talked about how they began to focus and learn about value-based enterprises (VBE), which became possible because of the 2020 CMS and OIG regulation revisions, during the pandemic, and have since developed a sizeable business helping clients create profitable ventures through the use of a VBE. Dr. Thramann offered a fascinating discussion of his movement from physician to entrepreneur, and his strong belief in the concept of VBE.

The second panel, “Operationalizing a Value-Based Enterprise,” was moderated by Mike Segal of Nelson Mullins. Panelists included Marc Miller, President and CEO of Health Strategies, LLC; Juliette Price (the keynote speaker), and Marc Auerbach, Chief Legal Officer and General Counsel, Genuine Health Group. The panelists offered an A to Z framework for creating a VBE, which is not an easy task, and provided important and practical tips on what is of particular importance in the process.

The third panel, moderated by Gabe Imperato of Nelson Mullins, was titled “Navigating the Compliance Landscape in Value-Based Care.” Panelists included Mandy Asgeirsson, Director of Berkley Research Group, LLC, and Ed White and Christine Worthen of Nelson Mullins. This panel focused on areas of compliance risk and how to operate in the value-based care space without falling into regulatory traps. The panelists offered excellent suggestions and guidance in this area.

The fourth panel, moderated by Heather Miller of Nelson Mullins, was titled “Integrating Specialty Care and Primary Care in Value-Based Arrangements.” Panelists included Kelly Conroy, Principal, Pinnacle Healthcare Consulting; Robert Ball, Chief Legal Officer, Enlace Health; and Dr. Thramann. They conducted a robust discussion about a very important and difficult topic: coordination between primary and specialty care in providing value-based services. They offered their vast knowledge to the attendees, who no doubt learned a great deal about this fascinating area.
