The Arkansas Department of Energy and Environment, Division of Environmental Quality, (“DEQ”) and Unilin North America, LLC, (“UNA”) entered into a September 27th Consent Administrative Order (“CAO”) to address alleged violations of an air permit. See LIS No. 19-091.
The CAO provides that UNA owns and operates a hardwood flooring manufacturing facility in Melbourne, Arkansas.
UNA is stated to have submitted a self-disclosure notification to DEQ referencing Air Operating Permit 0559-AOP-R9 (“Permit”).
The self-disclosure was provided to DEQ in a letter dated April 26th. The alleged violations are stated to have been discovered during a compliance review.
The self-disclosure letter is stated to have indicated that UNA failed to conduct failed to conduct the biennial boiler tune ups on the:
- Deltak Wood-fired boiler
- Keeler Wood-fired boiler
Such tune ups were required to have been undertaken within 25 months of the previous tune ups.
The alleged failures are stated to violate Specific Condition 16 of the air permit.
The self-disclosure letter stated that the boiler tune ups were conducted on the previously referenced sources on January 20, 2019. Further, the letter also stated that UNA has set up a calendar reminder to remind the corporate office and facility to conduct biennial tune ups and to submit reports to the agency.
UNA is stated to neither admit nor deny the factual and legal allegations contained in the CAO.
A civil penalty of $2,400 is assessed.
