Air Enforcement: Louisiana Department of Environmental Quality and Geismar Methanol Distribution Facility Operator Enter into Settlement

The Louisiana Department of Environmental Quality (“LDEQ”) and Kinder Morgan Liquids Terminals LLC (“Kinder Morgan”) entered into a Settlement to address alleged air permit violations. See SA-AE-22-073.

The Settlement provides that Kinder Morgan owns and/or operates a methanol distribution facility (“Facility”) in Geismar, Louisiana.

LDEQ is stated to have issued to Kinder Morgan a Notice of Potential Penalty on May 20, 2022. Kinder Morgan denies it committed any violations or that it is liable for any fines, forfeiture, and/or penalties.

The Facility is stated to operate pursuant to certain air permits.

An LDEQ investigation is stated to have identified the following alleged violations:

  • Failure to conduct the required annual maintenance for Emergency Generator GEN2
  • Failure to document the weekly pump inspections for the Railcar/Tank Truck Loading Operations and Scrubber
  • Failure to conduct the required maintenance for Emergency Generator GEN1

A civil penalty of $8,000 is assessed of which $439.41 is stated to represent LDEQ’s enforcement costs.
