Air Enforcement: Mississippi Commission on Environmental Quality and Pass Christian Pigment Manufacturing Facility Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and the Chemours Company FC, LLC (“Chemours”) entered into a November 14th Agreed Order (“AO”) addressing an alleged violation of an air permit. See Order No. 7288 23.

The AO addresses a pigment manufacturing facility (“Facility”) in Pass Christian, Mississippi.

The Facility is stated to have obtained a permit to construct (No. 1020-00115) issued in 2011. The permit was modified in 2012 for an Export Capacity Project.

The AO provides that the Facility failed to demonstrate compliance with the PM/PM10 (filterable + condensable) limit of 1.30 pounds per hour (3-hour average) during a stack test of an emission point on April 20th. The Facility is stated to have emitted 3.93 pounds per hour of PM and 2.51 pounds per hour during the stack test.

The Facility demonstrated compliance with the PM/PM10 (filterable + condensable) limit during a retest on May 25th.

The AO assesses a civil penalty of $45,000.
