The Missouri Department of Natural Resources (“MDNR”) and Jackson Municipal Utilities (“JMU”) entered into a July 17th Administrative Order on Consent (“Order”) addressing an alleged violation of an Operating (Air) Permit. See APCP-2022-046.
The Order describes JMU as the operator of an electric generating plant (“Facility”) owned and operated by the City of Jackson, Missouri.
The Facility is stated to include:
- Fuel oil storage tanks
- Diesel engines
- Natural gas-fired engine
- Space heaters
The Facility is a synthetic minor source of NOx emissions and an area source of hazardous air pollutant emissions.
The Order states that a Referral Notice of Violation was issued on August 9, 2022, to document JMU’s late submittal of a permit application renewal. The Facility’s permit requires a renewal permit application to be submitted at least six months prior to the date of expiration. It is alleged that because JMU submitted its permit application less than six months prior to the permit expiration, it operated with an expired permit for a period of time specified in the Order.
The MDNR Air Pollution Control program issued a new Intermediate Operating Permit on January 4th.
A civil penalty of $3,750 is assessed.
