The Tennessee Air Pollution Control Board (“Board”) issued a June 14th proposed Technical Secretary’s Order and Assessment of Civil Penalty (“Order”) to Cooper’s Steel Fabricators, Inc. (“Cooper’s”) addressing an alleged violation of an air permit. See Case No. APC 22-0042.
The Order provides that Cooper’s operates a facility (“Facility”) in Shelbyville, Tennessee.
The Technical Secretary is stated to have issued a True Minor operating permit on March 12, 2020, to Cooper’s. See Permit No. 077134 (“Permit”). The Permit is stated to address a shot blasting and surface coating operation.
Cooper’s is alleged to have failed to submit its annual National Emissions Standards for Hazardous Air Pollutants 40 CFR Part 63, subpart XXXXXX report ("Report") for 2021 to the Division of Air Pollution Control by January 31, 2022. As a result, Cooper’s is alleged to have violated Condition S3-3 of the Permit.
The Division of Air Pollution Control is stated to have received from Cooper’s the required report on March 14th.
The Order proposes a civil penalty of $1,500. Further, the Order provides Cooper’s certain appeal rights.
