The amendments to the Federal Rules of Civil Procedure have been in effect since December. It didn't take long for the courts to cite them with a steady stream of opinions. The first opinion arrived with CAT3, LLC v. Black Lineage (S.D.N.Y., Jan. 12, 2016) followed immediately by Gilead Sciences v. Merck & Co. (N.D.Cal., Jan. 13, 2016).

James Francis, who authored CAT3, JPMorgan Chase’s Brian Corbin and Hausfeld’s Bill Butterfield, an internationally recognized authority on e-discovery, who will recap the opinions and assess emerging trends in preservation, including how the courts and in-house legal teams are responding to changes in the Federal Rules since December.

Hon. James C. Francis IV Hon. James C Francis IV, United States Magistrate Judge, Southern District of New York

James C. Francis IV has been a United States Magistrate Judge in the Southern District of New York since October 1985. He received his B.A. from Yale College in 1974, his juris doctor degree from the Yale Law School in 1978, and a masters degree in public policy from Harvard University, also in 1978. Following graduation from law school, Judge Francis clerked for the Honorable Robert L. Carter in the Southern District of New York. He then joined the Civil Appeals and Law Reform Unit of the Legal Aid Society where he conducted impact litigation in the areas of housing and education and served as director of the Disability Rights Unit. Judge Francis currently serves as an Adjunct Professor at the Fordham University School of Law where he teaches Constitutional Torts.

Brian Corbin Brian Corbin, Vice President, Assistant General Counsel, JPMorgan Chase & Co.

Brian oversees several programs for JPMorgan Chase’s Legal Discovery Management group in Brooklyn, NY, supervising a multinational team focused on a range of discovery-related processes, including legal holds, information governance, retention policy, and defensible disposition. He and his team also manage cross-border discovery issues arising as a result of global data privacy and banking secrecy regulations. Prior to JPMorgan Chase, Brian worked with Clutch Group in Bangalore, India and Covington & Burling LLP in Washington, D.C.

William Butterfield William Butterfield, Partner, Hausfeld LLP

Mr. Butterfield is a partner at Hausfeld LLP, and focuses his practice on antitrust litigation, financial services litigation and electronic discovery. Mr. Butterfield is Chair of the Steering Committee for The Sedona Conference® Working Group on Electronic Discovery. He is also a member of Sedona Conference® Working Group on International Electronic Information Management, Discovery and Disclosure. In 2011, Mr. Butterfield testified before the House Judiciary Committee, Subcommittee on the Constitution, regarding the costs and burden of civil discovery. Mr. Butterfield is an adjunct professor at American University, Washington College of Law, where he teaches a course on electronic discovery. He also serves on the Advisory Board for the Georgetown University Law Center Advanced E-Discovery Institute.

Brad Harris Brad Harris, VP of Products, Zapproved
