Ammonia/OSHA Enforcement: Proposed Penalty Assessment for Madison, Wisconsin, Ice Cream Plant

The Occupational Safety and Health Administration (“OSHA”) issued a January 29th news release addressing AJLS Enterprises Inc. (operating as Schoep’s Ice Cream) (“AJLS”) citing alleged violations.

AJLS is described as operating an ice cream plant in Madison, Wisconsin.

Investigators with OSHA are stated to have determined that AJLS committed the following alleged violations:

  • Lack of lockout/tagout procedures.
  • Lack of machine guarding.
  • Failing to train workers in lockout/tagout procedures.
  • Not having a written hazard communication plan.
  • Failing to update the emergency action plan.
  • Ladder openings not protected from fall hazards.

The news release also cites a report of workers being exposed to anhydrous ammonia.

OSHA has proposed to assess $145,000 in penalties.

AJLS has 15 days from receipt of the citations and penalties to comply, request an informal conference with OSHA’s Area Director, or to contest the findings before the Independent Occupation Safety and Health Review Commission.
