The Alabama Department of Environmental Management (“ADEM”) issued an Administrative Order (“AO”) to Cork-Howard Construction Company, Inc. (“CHCC”). See Administrative Order No.: 18- ____-AP.

CHCC is described as a construction company based in Marietta, Georgia.

CHCC is stated to have been hired to demolish a commercial building in Madison County, Alabama (“Site”).

ADEM is stated to have conducted an inspection of the Site on October 18, 2017. The inspection is stated to have noted a commercial building had been demolished without ADEM receiving a Notice, allegedly in violation of ADEM Admin. Code r. 335-3-11-.02(12).

ADEM is stated to have issued a Notice of Violation to Madison Station, LLC, described as the owner of the Site. ADEM is stated to have received a response from Madison Station, LLC on November 13, 2017. A Madison Station, LLC response stated that an asbestos survey had been performed and no regulated asbestos material was found. The response further stated that CHCC was hired to conduct the demolition of the Site.

The AO requests that no later than 45 days after its issuance CHCC pay ADEM a civil penalty in the amount of $2,500 for the alleged violations. Further, CHCC, upon receipt of the AO, is required to ensure immediate and future compliance of 40 C.F.R. Part 61, Subpart M, as it applies to renovation and demolition operations.
