Dechert recently filed an amicus brief on behalf of more than one hundred economists, including two Nobel laureates, in the Court of Appeals for the Eleventh Circuit in support of the lower court's ruling that the individual mandate provision of the Patient Protection and Affordable Care Act was unconstitutional. The brief deconstructs the economic data relied upon by the U.S. Government to show that the individual mandate provision cannot rationally be justified as an exercise of the federal power to regulate interstate commerce. Dechert attorneys Steven G. Bradbury, Steven A. Engel, Michael Park and Joshua Richards filed the brief.
