A highlight from this issue includes: 

  • Individuals with Disabilities Education Act (IDEA). The Fourth Circuit joined the Seventh Circuit, the D.C. Circuit, and the First Circuit in holding that to meet the commonality requirement in an IDEA case, the plaintiff must identify a “uniformly applied, official policy of the school district, or an unofficial yet well-defined practice, that drives the alleged violation.”
