Design-Build Institute of America will host a webinar, titled "Making the Most of Public-Private Partnerships (P3s) in Arkansas," on Wednesday, June 13. Matt Girard, who leads the Civil Division at the Plenary Group, and others will be speaking about P3 design-build-finance-operate-maintain (“DBFOM”) projects. P3 projects and the statutory authority for them are relatively new in the Natural State, but Arkansas municipalities and state agencies are interested in using public-private partnerships to help fulfill the infrastructure needs in the state.
In Arkansas, the statutory authority for P3 water, transportation, and social infrastructure projects is located in three separate sections of the Arkansas Code. Under A.C.A. 22-9-203(j), municipalities and authorities can enter private party P3 DBFOM agreements for water treatment or storm water projects. For social infrastructure projects, among others, A.C.A. § 22-10-101 provides the necessary enabling legislation. For roads, bridges, and similar state projects, A.C.A. 27-67-206(j) provides that Arkansas Department of Transportation can enter DB, DBF, DBOM, and concession P3 agreements with a private party.
