Environmental Case Law Update – 1st Six Months of 2017

On March 21, 2017, the United States Supreme Court decided the case of National Labor Relations Board v. SW General, Inc. This case concerns the operation and application of the Federal Vacancies Reform Act of 1998 (FVRA). The NLRB’s Regional Director, exercising authority on behalf of Lafe Solomon, the agency’s acting General Counsel (who served in that capacity for many months without Senate confirmation), filed a complaint against SW General alleging that the ambulance company had committed unfair labor practices.
