What can we learn about negotiation skills and mediation prep from Tim Robbins, Morgan Freeman, and Julia Roberts?

The initial 2-3 hours of a mediated settlement conference can sometimes feel a bit like a protracted siege in wartime: each side may be locked into its position, unwilling to blink or to give even an inch until it sees some sign of capitulation from the other side.

Might there be a better way? What if we could change the way we prepare our clients for mediation, so as to render the process more efficient, less stressful (for all involved), and perhaps even more likely to result in a workable settlement agreement?

The Shawshank Redemption (and a few other classic films), to demonstrate how a few simple but profound adjustments to the mediation preparation process might lead to more effective and productive negotiations and settlement conferences.

Drawing upon Chris’ 20+ years of litigation experience and his 10+ years' experience as a mediator and law professor teaching mediation and negotiation skills, this seminar will equip participants to understand—and leverage the value of—emotional intelligence training and other insights gleaned from the social sciences to become more effective conflict resolution coaches for their clients.

You will learn about and have opportunities to practice effective strategies and techniques for:

  • Helping clients prepare for the mediation process by educating them regarding the latest insights in negotiation theory, and the need for a different type of advocacy than what they may be used to or be expecting.
  • Recognizing when a dispute may be become more complex than anticipated.
  • Helping clients to identify and prepare for any emotional or psychological challenges (including, e.g., feelings of grief, betrayal, or animosity) that may be complicating any efforts at compromise or amicable resolution.
  • Identifying the most common different conflict resolution styles, and learning how to leverage the strengths (and compensate for the weaknesses) of each approach.

Do I have to bring my printed ticket to the event?

No, we have sophisticated techincal doohickeymajigs that allow wireless/virtual/moble/cybersmart check in. Feel free to bring your printed ticket just in case there is any issue with your registration, or in the event you want to make paper airplanes and fly them at the presenter when he cracks a painfully unfunny joke.

What is the refund policy?

You may cancel and receive a refund at any time before 5:00 P.M the day before the event. On the day of the workshop, refunds are typically given only for unforeseeable exigent circumstances (medical or personal emergencies, last-minute court hearings, and the like). If you are unable to attend for any reason of that sort, or something similar, and no one else from your firm is willing and able to take your place, please give us as much advance notice as possible, and we will see what we can do (based on such factors as whether the event is sold out, whether you invite us to come do some CLE or PD workshops for your firm, etc.).
