Fairness Hearings: Not Just For Reorganizations

California attorneys are fortunate to have a wealth of resources at their disposal. One of these treasures is the Continuing Education of the Bar – California (CEB). The University of California and the State Bar of California founded CEB more than 60 years ago. CEB is, however, self-supporting. Among numerous other publications, the CEB publishes The California Business Law Practitioner as well as the California Business Law News.

Yesterday, I wrote about fairness hearings under Corporations Code § 1001 and mentioned an article that I had written a few years back. I failed to mention a much more recent article on the subject written by W. Anthony Colbert. The article appears in the Spring 2010 issue of The California Business Law Practitioner. Mr. Colbert is a Senior Counsel with the California Department of Corporations and has served as hearing officer in numerous fairness hearings. Mr. Colbert’s article discusses the various types of fairness hearings conducted by the Department as well as the mechanics of the fairness hearing itself.
