On March 27, 2019, U.S. Citizenship and Immigration Services (USCIS) issued an updated notification that the agency had received enough electronic registrations in the initial filing period to reach FY 2021 H-1B CAP allocations.

USCIS will now begin the process of selecting registrations and notifying petitioners of selected registrations by March 31, 2020. Those petitioners with selected registrations will then be eligible to file H-1B CAP cases for the named beneficiaries.

Online accounts will now show one of the following status updates for each registration:

  • Submitted: These registrations were not selected but will remain in consideration until September 30, 2020, the end of the fiscal year.
  • Selected: These registrations have been selected to file an FY 2021 H-1B CAP case.
  • Denied: A duplicate registration was submitted or the payment method was declined and not reconciled. Denials for duplicate registrations result in denials of all registrations for that named beneficiary.

DISCLAIMER: Because of the generality of this update, the information provided herein may not be applicable in all situations and should not be acted upon without specific legal advice based on particular situations.
