New UCITS Regulations and Feedback Statements
The Central Bank of Ireland published the Central Bank UCITS Regulations and feedback statements on CP77 – Consultation on publication of UCITS Rulebook and CP84 – Consultation on adoption of ESMA’s revised guidelines on ETFs and other UCITS issues on Monday 5 October 2015.
The UCITS Regulations consolidate all of the regulatory requirements imposed on UCITS, UCITS management companies and depositaries of UCITS.
Update to AIFMD Q&A
The Central Bank of Ireland published the sixteenth edition of the AIFMD Q&A on Monday 5 October 2015.
The document is intended to provide answers to queries likely to arise in relation to the implementation of the AIFMD.
UCITS Q&A Updated
The Central Bank published a revised UCITS Q&A document (the eighth edition) on Friday 23 October 2015. The updated Q&A provides additional guidance with respect to the transitional provisions for the Central Bank UCITS Regulations published on 5 October 2015.
Q&A for Investor Money Regulations
The Central Bank of Ireland published the first edition of the Investor Money Q&A, on Monday 5 October 2015. The Investor Money Q&A sets out answers to queries likely to arise with relation to the implementation of the Investor Money Regulations (the “Regulations”), which will be effective from 1 April 2016. The Regulations will apply to Irish fund service providers who own and operate bank accounts for the collection of investor subscription and redemption monies. The purpose of the Regulations is to ensure administrators, custodians, management companies and transfer agents have robust systems in place to protect the ownership rights of client with regard to their invested assets.
