On October 4, 2023, the Joint Panel on Multidistrict Litigation (JPML) issued a Transfer Order consolidating certain actions relating to a vulnerability in Progress Software’s MOVEit file transfer software which was exploited by a Russian cybergang in May 2023.

The JPML broadly noted that other actions, including yet-to-be filed actions, relating to this vulnerability—whether filed against Progress Software, direct users of the MOVEit software, or companies that contracted or subcontracted with direct users of MOVEit—are potential tag-a-long actions. Given the breadth of this ruling, we have prepared these FAQs concerning the Transfer Order and its implementation.
