With only a couple of weeks to go until Election Day, here are your public-law highlights:
-
Election coverage galore. Media outlets are turning their attention to our federal, state, and local elections. Attorney Chris Jackson was quoted in the Colorado Sun, the Colorado Independent, and Westword on issues ranging from Amendment 75 to dark money.
-
Colorado Court of Appeals upholds gun law. Colorado’s intermediate appellate court ruled that a law prohibiting large-capacity magazines did not violate the state constitution. Colorado Politics quotes attorney Chris Jackson in reporting that the plaintiffs will appeal the decision to the state supreme court.
-
Chief Justice Roberts refers Kavanaugh complaints to the Tenth Circuit. The Chief Justice sent more than a dozen judicial misconduct complaints against now-Justice Kavanaugh to the Tenth Circuit. Those complaints, which arise out of conduct that took place before Kavanaugh’s elevation, likely won’t go anywhere: the Supreme Court’s members aren’t bound by the disciplinary rules that govern circuit court judges.
-
Gessler files cert petition. Former Colorado Secretary of State Scott Gessler filed a cert petition asking the US Supreme Court to weigh in on whether the state’s Independent Ethics Commission violated the federal constitution when it determined that Gessler improperly sought reimbursement for certain travel expenses. The Court may rule on the petition as soon as this week.
