In New Jersey, Executive Order (EO) 109 requires all businesses to submit an inventory of personal protective equipment (PPE), ventilators, respirators and anesthesia machines by Friday, March 27 via this online portal. Although the form does not explicitly discuss the submitter’s own needs, parties should strongly consider describing their own need for some or all of the available inventory in the “comment” section. For example, if a six-month supply of PPE exists but critical operations require only a three-month supply, this can be added to the comments. Finally, as the crisis widens across the country, we can envision other states imposing similar inventory requirements.
