The Occupational Safety and Health Administration (“OSHA”) issued an April 28th news release stating it had cited Xylem Inc. (“Xylem”), for alleged violations.

Xylem is described as a water technology company.

OSHA states that a Xylem worker suffered an injury when a guardrail loosened. The worker is stated to have fallen and struck his head on a support beam as he lowered himself into what is described as a “nearly 30-foot deep water test pit.”

OSHA alleges that its inspector determined that the company:

• Exposed employees to waling-working surfaces hazards
• Failed to provide employees with fall protection before they entered a 100 by 24-foot water-testing pit
• Failed to follow specific permit-required confined spaces safety procedures prior to entering the water test pits

Xylem is described as a company that “tests, troubleshoots and repairs large industrial water treatment pumps used by power plants and municipalities.”

OSHA proposes to assess penalties of $234,054.

The company has 15 days from receipt of the citation and penalties to comply, request an informal conference with OSHA’s Area Director, or contest the findings before the Independent Occupational Safety and Health Review Commission.
