President Trump’s Travel Suspension Proclamation

Last night, President Trump issued a proclamation suspending entry into the United States of all non-exempt foreign nationals who were physically present within the Schengen Area (Austria, Belgium, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, and Switzerland) during the 14-day period preceding their entry or attempted entry into the United States. This travel prohibition begins at 11:59 p.m. eastern daylight time on March 13, 2020. It will not apply to persons aboard flights scheduled to arrive in the United States that departed prior to 11:59 p.m. eastern daylight time on March 13, 2020.

Among those exempt from the suspension are,

  • lawful permanent residents of the United States; and
  • foreign nationals who are spouses of U.S. citizens or lawful permanent residents.

A full list of the exemptions may be found in the proclamation.

While in his televised speech, President Trump said that the suspension would last for 30 days, the written proclamation states that it will remain in effect until terminated by the President.

We expect further details to be released in forthcoming policy memos from the Departments of State and Homeland Security. Upon issuance, we will provide additional guidance.
