The Arkansas Department of Energy & Environment – Division of Environmental Quality (“DEQ”) circulated a reminder that states:

The 2023 Biennial Report module in RCRAInfo is now open to start capturing data.

DEQ also states:

  • Facilities may begin entering data for the 2023 Biennial Hazardous Waste Report; however, submittals will not be allowed until after January 1, 2024. This report is due on or before March 1, 2024.

The Resource Conservation and Recovery Act (“RCRA”) is the federal environmental statute creating the framework for proper management of hazardous and non-hazardous solid waste. Subtitle C of RCRA addresses the management of hazardous waste from cradle (i.e., generation through transportation) to grave (disposal).

Arkansas was delegated the federal RCRA program in the mid-1980s. As a result, it implements the program through Arkansas Pollution Control & Ecology Rule 23.

The report referenced by DEQ is one that must be submitted addressing the nature, quantities, and disposition of hazardous waste generated at a facility.

The DEQ reminder outlines who is required to report as:

  • Any facility that was a fully-regulated Large Quantity Generator (LQG) or Small Quantity Generator (SQG) during any month.
  • Any facility that treated, stored, or disposed of RCRA hazardous wastes on-site in a waste management unit subject to RCRA permitting requirements.
  • Facilities that are on file with DEQ as a LQG or SQG.
