Reminder: Pupil transportation deadlines

It’s a busy time for our pupil transportation supervisors. Amidst the day-to-day operations for this year, plans are underway for the 2023-2024 school year. Due to recent legislation (House Bill 110, passed in 2021),1 there are additional procedural steps that need to be taken, particularly when it comes to transporting students to non-public schools and community schools.

Below you will find a reminder of two key crucial process points and a link to the Ohio Department of Education (ODE) monthly calendar:

Transportation plans

By April 1, non-public and community schools were supposed to notify school districts of their start/end times. Upon receiving a plan, the school district has 60 days to develop a transportation plan and send it to the non-public or community school. If the start/end times are provided after April 1 (but before July 1), the district must “attempt” to provide a plan by August 1.  See Ohio Revised Code Section 3327.016.

Impracticality decisions

A school district that has previously determined transportation is impractical for a non-public or community school or is considering making such a determination should consult with legal counsel now to ensure they follow the many procedural requirements. 

The new law requires a school district to make a determination no later than 30 calendar days prior to the first day of instruction. It also requires a detailed explanation be provided to parents, which must be based on the six factors outlined in Ohio Revised Code (Section 3327.02). It is important to note that the ultimate decision to approve or disapprove a district’s determination is the State Board of Education.  Keep in mind, this process has taken over a year for some school districts. 

ODE Transportation dates calendar

In January, ODE released a helpful monthly calendar with key action steps. School districts can consult this calendar to keep an eye on what must occur in the spring and summer.
