Rente mit 63 – Probleme für Arbeitnehmer in der Altersteilzeit

Das RV-Leistungsverbesserungsgesetz sieht vor, zum 1. Juli 2014 die Altersgrenze für eine abschlagsfreie Rente auf 63 Jahre nach 45 Beitragsjahren abzusenken. Diese Absenkung stellt Arbeitnehmer in Altersteilzeit vor ein nicht zu vernachlässigendes Problem. Viele Tarifverträge sehen vor, dass das Arbeitsverhältnis automatisch endet, wenn der Arbeitnehmer abschlagsfrei Rente beanspruchen kann. Bislang basierte die Kalkulation der Altersteilzeitmodelle auf einem Renteneintrittsalter von 65 Jahren. Durch die Möglichkeit, ab 1. Juli 2014 die abschlagsfreie Rente zwei Jahre früher zu beanspruchen, kommt es zu einem sog. „Störfall“ im Altersteilzeitverhältnis. Nach dem Altersteilzeitvertrag hätte der Arbeitnehmer noch zwei weitere Jahre von dem höheren Arbeitsentgelt nebst Aufstockungsbeträgen profitieren können. Nun muss er sich jedoch mit der niedrigeren Rente zufrieden geben.

Aufgrund dieser Problematik hat der Gesetzgeber mit § 15h ATG eine Vertrauensregelung eingeführt. Gemäß § 15h ATG erhält der Arbeitgeber die Aufstockungsbeträge weiterhin von der Bundesagentur für Arbeit ersetzt, wenn er sie trotz eines Anspruchs auf eine ungeminderte Rente ab 63 Jahren weiterhin an den Arbeitnehmer zahlt. Dem Arbeitgeber und dem Arbeitnehmer bleibt aber selbst überlassen, ob sie den Altersteilzeitvertrag überhaupt weiter laufen lassen. Diesbezüglich trifft § 15h ATG keine  ntscheidung. Der Gesetzgeber wollte mit der Regelung in § 15h ATG lediglich die Vertragsparteien anstoßen, ihre Verträge an die neue Rechtslage anzupassen. Wörtlich heißt es „Altersteilzeitfälle sollten auch dann bis zum vereinbarten Ende laufen können, wenn in vertraglichen Vorschriften eine vorzeitige Beendigung der Altersteilzeit vorgesehen ist, sobald ein Anspruch auf eine ungeminderte Rente besteht“ (BT-Drucks. 18/1489 S. 26). Den Vertragsparteien bleibt nunmehr nicht mehr ein Monat Zeit, das Problem unter Würdigung der neuen Rechtslage zu bewältigen.
