A critical question about the regulation of cryptocurrencies that has long been apparent, but until recently has been lying dormant, has now vaulted to the forefront of the conversation: Do cryptocurrencies that function primarily as a medium of exchange and otherwise operate like traditional currencies (e.g., ether, ripple and bitcoin) qualify as securities under the U.S. securities laws?
