An excerpt from Where did these cases come from?
- Historically, plaintiffs class action lawyers get ideas for new claims from a variety of sources: state attorney general investigations, FTC consent judgments, investigative journalism, regulatory agency warning letters, their own imagination, and commonly what we will refer to as the “herd mentality” where the filing of one case leads to copycat cases against the same or other similar defendants. We believe this particular set of cases developed under the herd mentality.
