Stormwater Enforcement: Mississippi Commission on Environmental Quality and George County Subdivision Developer Enter into Agreed Order

The Mississippi Commission on Environmental Quality and D.R. Horton, Inc. (“D.R. Horton”) issued a September 20th Agreed Order (“AO”) addressing an alleged violation of the Mississippi Code provisions addressing stormwater permitting. See Order No. 7276 23.

The AO provides that D.R. Horton was contacted by the Mississippi Department of Environmental Quality regarding a violation at its Magnolia Farms Subdivision construction site.

The construction site is stated to be located in George County, Mississippi.

D.R. Horton is alleged to have failed to obtain coverage under Mississippi’s Large Construction Stormwater General NPDES Permit prior to commencement of construction activities in violation of Miss. Code Ann. § 49-17-29(2)(b).

The Mississippi Department of Environmental Quality is stated to have issued a certificate of permit coverage under Mississippi’s Large Construction Stormwater General NPDES Permit to D.R. Horton on June 6th.

The AO assesses a civil penalty of $5,250. A copy of the AO can be downloaded here.
