Stormwater Enforcement: U.s. Environmental Protection Agency And Kiryas Joel, New York, Poultry Processing Facility Enter Into Consent Agreement

Mitchell, Williams, Selig, Gates & Woodyard, P.L.L.C.

The United States Environmental Protection Agency (“EPA”) and Kiryas Joel Poultry Processing Plant (“KJPPP”) entered into a March 15th Consent Agreement and Final Order (“CA”) addressing an alleged violation of a Clean Water Act Multi-Sector General Permit (“MSGP”) (GP-0-17-004). See Docket No. CWA-02-2023-3305.

The CA provides that KJPPP operates a poultry processing facility (“Facility”) in Kiryas Joel, New York.

The Facility is stated to have had unauthorized discharges of processed wastewater on May 9, 2022, and September 20, 2022, to catch basins that discharge via point sources to a tributary of the Ramapo River. Such discharges are alleged to have not been authorized by the coverage provided by the MSGP from KJPPP’s Pretreatment Facility.

KJPPP neither admits nor denies the factual allegations contained in the CA.

A civil penalty of $19,000 is assessed.
