Delayed again!

Not long ago, I posted that the U.S. Supreme Court was going to consider tomorrow whether to review three court of appeals decisions addressing whether Title VII's ban on "sex" discrimination applies to discrimination based on sexual orientation and gender identity.

But this past Monday, the Court said, with no explanation, that consideration of these cases has been "rescheduled." There is no new date at this time, but the next conference after today's will be on December 7. That's the last one for 2018.

We will, of course, continue to keep you posted. In the meantime, you might be interested in this post that I recently wrote for the North Carolina Bar Association on the arguments pro and con.
