The United States Army Corps of Engineers (Vicksburg District) (“Corps”) issued a September 25th Public Notice stating it was reissuing Department of the Army General Permit 32.
The Vicksburg District includes a portion of Arkansas.
General Permit 32 applies to discharges of dredged and/or fill material in waters of the United States, associated with construction of minor drainage and water level control structures.
Widely used drainage and water control structures are stated to include, but are not limited to:
- cantilever overfall pipes
- drop inlet structures
- water level control structures
- grade and erosion control structures
Permits issued by the United States Army Corps of Engineers Districts authorize various types of activities in wetlands and other waters in the United States. The regulatory process involves various types of permits.
An Individual Permit authorizes specific activities on a case-by-case basis. In contrast, General Permits provides standing permission for all activities that fit within the description of the permit. They are used to minimize the burden of the regulatory programs.
General Permits provide for pre-authorized permission for activities that conform to the standards of the permit. Certain General Permits may require some type of authorization from or notice to the United States Army Corps of Engineers prior to starting work. The Corps is required to periodically (renew or reissue) expiring General Permits.
The General Permit contains certain conditions and limitations that are intended to protect the environment and natural and cultural resources. Further, the Corps reserves the right to require an individual permit application if it is deemed necessary.
