The Mississippi Commission on Environmental Quality (“MCEQ”) and the Town of Roxie, Mississippi, entered into a May 11th Agreed Order (“AO”) addressing alleged violations of a Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit. See Order No. 6850 18.
The AO provides that Roxie, Mississippi, operates a wastewater treatment facility in Franklin County, Mississippi.
Roxie is stated to have been contacted by MCEQ and notified of violations of its NPDES permit at the wastewater treatment facility. The violations are alleged to include:

The Total Suspended Solids Minimum Percent Removal limitation was exceeded for 2016 and 2017.

The 5-day Biochemical Oxygen Demand Maximum Monthly Average limitation was exceeded for 2016 and 2017.

The 5-day Biochemical Oxygen Demand Minimum Percent Removal Limitation was exceeded for 2017.
-
The Total Residual Chlorine Maximum Monthly Average limitation was exceeded for 2017.
-
The Total Residual Chlorine Maximum Weekly Average was exceeded for 2017.
The AO provides that Roxie shall complete the following upgrades to the wastewater treatment facility which include:

Installation of a new gas feed chlorination/de-chlorination disinfection system

Repair seven lift stations, as needed

Clean collection system and perform line point repairs, as needed, to address Inflow and Infiltration
Documentation of the upgrades must be provided within 30 days of being undertaken or by November 30, 2019, whichever comes first.
The AO assesses a civil penalty of $750.
