About the Speakers
Jason Schigelone - Moderator

Jason focuses his practice on patent litigation and prosecution in the chemical, medical and mechanical arts.  He has experience in domestic and international patent prosecution and patent clearance opinions, and has represented clients through all stages of litigation in the federal district courts and before the Court of Appeals for the Federal Circuit.  Jason has handled matters involving a variety of technologies, including interventional medical devices and healthcare products, pharmaceuticals, biosensors, climate control, and automotive systems.

Jason is known for his thorough and detailed understanding of his client’s technologies and business, and his ability to translate this information into successful legal strategies and outcomes.

  David Bernard
 

When working with a client, David thinks forward to the client’s overall goal, whether it is protecting a specific product or building a stronger overall portfolio. His mechanical engineering background and biomechanical expertise allows him to work closely with clients as an integral member of their project teams.
 
A registered patent attorney, David focuses his practice on patent litigation and prosecution in diverse fields including medical devices, industrial services, and telecommunications. David has experience at both the federal district and appellate court levels, including fact and expert discovery, motion practice, and claim construction. David also has experience with patent prosecution and drafting opinions on complex non-infringement, right-to-use, and patentability issues.

  Joshua James

Energetic and committed, Josh James brings a strong background in biomedical and chemical engineering to helping clients strengthen and enforce their intellectual property rights. His practice focuses on patent litigation, particularly Hatch-Waxman pharmaceutical litigations in federal courts and inter partes review (IPR) proceedings before the Patent Trial and Appeal Board (PTAB).
 
Josh’s scientific knowledge helps him hit the ground running, especially in cases involving highly complex chemical compounds. He easily meets technical experts on their own terms and uses that knowledge to take a key role on joint-defense groups. Thinking forward, Josh is able to use his training to help identify and prepare scientific experts for litigation.

  Andrew McElligott

Drew McElligott focuses his practice on patent and trademark litigation. He represents leading companies in the pharmaceutical and medical device sectors, as well as consumer products manufacturers.
 
Prior to law school, Drew spent four years conducting scientific research at the Loyola University Cardiovascular Institute, where he gained invaluable experience in a variety of surgical and diagnostic procedures as well as viral and histological techniques.  This strong technical background informs every aspect of Drew’s litigation practice, from understanding the core technologies of his clients’ products to crafting creative legal strategies that protect and defend their innovations.
