OFCCP published its new audit Scheduling Letter on Friday August 25, 2023, effective the previous day. It is the most comprehensive and burdensome change to the agency’s audit Scheduling Letter since 1988. It adds almost 30 new document requests to its already lengthy “Itemized Listing” seeking over 20 documents or document sets from contractors to jump start OFCCP’s “Desk Audit” of a covered Federal Government Supply and Service contractor or subcontractor.

In this 90-minute webinar, we will discuss all the changes, identifying the four primary options contractors have available to them to respond to the new audit Scheduling Letter, and while the Affirmative Action community awaits a coming new OFCCP CSAL identifying federal contractors for audit under the new Scheduling Letter.

Host and moderator Candee Chambers will lead two lawyers who have collectively defended hundreds of OFCCP audits to share their insights and practical tips for future application:

John C. Fox, Esq., Partner, Fox Wang & Morgan P.C., previous Executive Assistant to the OFCCP Director, who has both led OFCCP’s enforcement strategy nationwide but also many audits while at OFCCP. John has now defended contractors for three decades in hundreds of audits.

Jay J. Wang, Esq., Partner, Fox Wang & Morgan P.C, has defended many complex OFCCP audits, as well as some of the largest OFCCP court prosecutions of federal contractors in recent years (and was in trial for 10 weeks, with John, on OFCCP’s largest most recent failure to hire case).
