The Mississippi Commission on Environmental Quality (“MCEQ”) and Associated Wholesale Grocers, Inc., (“AWGI”) entered into a September 4th Agreed Order (“AO”) addressing alleged violations of a water-pretreatment permit. See Order No. 6885 18.
The AO provides that AWGI operates a facility (“Facility”) located in Southaven, Mississippi.
The Facility is stated to hold Water-Pretreatment Permit No. MSP091043. AWGI is stated to have been notified of violations of the pretreatment permit, which include:

Outfall 001: Violation of Biochemical Oxygen Demand (BOD) milligram per liter (mg/L) annual average limitation of 250 mg/L for the monitoring periods of 2016 and 2017.

Outfall 001: Violation of Biochemical Oxygen Demand (BOD) milligram per liter (mg/L) daily maximum limitation of 375 mg/L for the monitoring periods of 2016 and 2017.

Outfall 001: Violation of Total Suspended Solids (TSS) milligram per liter (mg/L) annual average limitation of 300 mg/L for the monitoring period of 2017.

Outfall 001: Violation of Total Suspended Solids (TSS) milligram per liter (mg/L)daily maximum limitation of 450 mg/L for the monitoring period of 2017.

Outfall 001: Violation of Oil and Grease milligram per liter (mg/L) annual average limitation of 100 mg/L for the monitoring period of 2017.
AWGI informed MCEQ in June 7th correspondence that it had returned to compliance with the discharge limitation in the pretreatment permit.
The AO assesses a civil penalty of $7,000.
