With a new Administration and executive branch, we are already seeing changes to the judiciary, with numerous new judges already nominated and confirmed, and a new Justice on the Supreme Court already participating in and writing decisions. Plan sponsors must be vigilant of change, and prepare for the future by minimizing litigation exposure, while also maximizing strategy and tactics.
