AG Frosh Announces Settlement with Alleged Polluting Poultry Plant

  • Maryland AG Brian Frosh and the Maryland Department of the Environment (MDE) reached a settlement with poultry processor Valley Proteins, LLC to resolve allegations that Valley Proteins illegally discharged pollutants into a tributary river of the Chesapeake Bay for over a year in violation of state water pollution laws and the company’s National Pollutant Discharge Elimination System (NPDES) Permit, among other things.
  • According to the complaint, inspections of Valley Proteins’ poultry rendering facility in Linkwood, Maryland from 2019 to 2022 revealed a wide range of alleged violations, including unauthorized discharges of substances such as ammonia, nitrogen, and phosphorus into the ground and water and alleged failure to properly maintain pollution mitigation equipment and data, among other things.
  • Under the terms of the Consent Decree, Valley Proteins will pay $540,000 in civil penalties and additional penalties if it fails to meet the requirements of the Consent Decree; will pay into the Transquaking River Watershed Fund; must correct certain existing violations; and will pay attorneys’ costs and fees.
