The Arkansas Department of Energy & Environment – Division of Environmental Quality (“DEQ”) and AHF, LLC, d/b/a AHF Products (“AHF”) entered into a May 24th Consent Administrative Order (“CAO”) addressing alleged violations of an air permit. See LIS No. 23-032.
The CAO provides that AHF owns and operates a hardwood flooring facility (“Facility”) in Warren, Arkansas.
The Facility operates pursuant to an air permit.
DEQ is stated to have undertaken an inspection on July 20, 2022, of the Facility.
The inspection is stated to have determined that AHF in its semi-annual monitoring report recorded the use of four unauthorized hazardous pollutants (glycol ethers, chromium compounds, cobalt compounds, and manganese compounds) for an 11-month period from February 2021 through January 2022.
Such acts are alleged to violate General Provision 23 of the permit.
AHF submitted a permit modification application on December 9, 2022, to address the compliance issues.
The CAO provides that AHF neither admits nor denies the factual and legal allegations contained in the CAO.
Until such time as the referenced permit modification becomes final, AHF is required to operate in accordance with the application submitted on December 9, 2022.
A civil penalty of $7,920 is assessed.
