The Arkansas Department of Energy & Environment – Division of Environmental Quality (“DEQ”) and Paragould Light Water & Cable (“Paragould”) entered into an April 11th Consent Administrative Order (“CAO”) addressing an alleged violation of an air permit. See LIS No. 23-027.

The CAO provides that Paragould owns and operates a natural gas-fired-combined-cycle electric power plant (“Facility”) in Greene County, Arkansas.

The Facility is stated to operate pursuant to an air permit.

Paragould is stated to have submitted a report of results for compliance testing conducted at Generator #6 (SN-06) on September 15, 2022. Correspondence indicated that SN-06 had not operated since its testing in September 2022. SN-06 would be restarted during the week of November 14, 2022, for purpose of demonstrating compliance with the permit’s carbon monoxide (“CO”) concentration limit through retesting of the unit.

DEQ is stated to have informed Paragould that an evaluation of the test report for testing conducted at SN-06 indicated a CO concentration of 48.15 ppmvd at 15% oxygen at SN-06. This is stated to have exceeded the permit limit of 47.0 ppmvd at 15% oxygen, violating Specific Condition 15(b) of the air permit.

Paragould submitted a report of results for compliance retesting conducted at SN-06 on November 16, 2022. DEQ informed Paragould that compliance was demonstrated.

Paragould neither admits nor denies the factual and legal allegations contained in the CAO.

A civil penalty of $880 is assessed which could have been reduced to one-half if the document was signed and returned to DEQ by April 28, 2023.
