Air Enforcement: Arkansas Department of Energy & Environment - Division of Environmental Quality and Monticello Polystyrene Manufacturing Facility Enter Into Consent Administrative Order

The Arkansas Department of Energy & Environment – Division of Environmental Quality (“DEQ”) and Drew Foam Companies, Inc. (“Drew”) entered into an October 16th Consent Administrative Order (“CAO”) addressing an alleged violation of an air permit. See LIS No. 23-076.

Drew is stated to own and operate an expandable polystyrene manufacturing facility (“Facility”) in Monticello, Arkansas.

The Facility operates pursuant to an air permit.

DEQ is stated to have conducted a compliance inspection at the Facility on April 20th. The inspection is stated to have covered the reporting period of March 1, 2021, through March 31, 2023.

The inspection is stated to have determined that Drew failed to conduct the required annual maintenance on SN-15 and SN-16. This allegedly violates Specific Condition 15 of the air permit.

Drew responded to a DEQ query regarding the alleged compliance issues on June 14th and stated that recordkeeping for each emission source had been transitioned to digital software. This is stated to have eliminated the need for paper documentation and allowing for the scheduling of required tasks, tracking of monthly run hours and gas usage, calculations of emissions by source, and documentation of all maintenance work. Further, Drew stated that required preventive maintenance tasks have been developed and assigned to the responsible parties at the Facility with records available upon request for review.

Signed correspondence confirming that all maintenance testing of SN-15 and SN-16 had been completed in accordance with the permit was submitted to DEQ on July 15th.

The CAO provides that Drew neither admits nor denies the factual and legal allegations contained in the CAO.

A civil penalty of $1,920 is assessed.
