A bill amending the Alabama Solid Wastes and Recyclable Materials Management Act by specifying when local approval of solid waste disposal permit modifications is necessary has passed both houses of the Alabama Legislature and is now law. 

Under Act Number 2023-290, local governing body review and approval of permit modifications for landfills will be required only when the landfill seeks to:

  1. Increase the service area.
  2. Convert from an industrial or construction and demolition landfill into a municipal solid waste landfill, or convert from a construction and demolition landfill into an industrial landfill.
  3. Add acreage to the landfill boundary in an amount equal to or less than fifty percent of the existing boundary.  (Acreage additions greater than fifty percent of the existing landfill boundary also require local review and approval, but under different statutory procedures.)
  4. Change the mode of transportation of solid waste to the solid waste management facility.
  5. Increase the average daily volume of waste.

The new law offers procedural clarity for landfill owners and operators, as well as others associated with the solid waste disposal industry, and will be a fundamental aspect of operational planning.
