On Friday, August 28, 2020, California Governor Gavin Newsom unveiled a new and simpler four-tiered classification system, the Blueprint for a Safer Economy, to evaluate regional and business-sector health risk and to guide counties as they reopen businesses closed due to the COVID-19 pandemic. Businesses across the state have largely been closed since the Governor issued the first Stay-at-Home Order on March 19, 2020, and additional restrictions were put in place in July. Prior to August 28, the state was tracking counties’ COVID-19 metrics via a Monitoring List, with counties on the list subject to additional restrictions. That list has now been replaced with the four-tiered Blueprint. Counties in California are now subject to a streamlined set of restrictions based on the tier into which they fall, which is determined by case counts per 100,000 residents and test positivity rates. On Monday, March 9, 2021, the state updated the Blueprint metrics to take into account vaccination progress across California. As the state provides vaccine doses, the thresholds for counties to move into the various tiers are adjusted as follows:

  • Once 2 million vaccine doses have been administered in the state to the communities with the lowest score in the Healthy Places Index, the threshold to move from the purple tier to the red tier will go from 7 new cases per 100,000 people to 10 new cases per 100,000 people. To move to the orange tier, the threshold will remain at 4 cases per 100,000 people, and to move to the yellow tier, the threshold will remain at 1.
  • Once 4 million vaccine doses have been administered in the state to the communities with the lowest score in the Healthy Places Index, the threshold to move from the purple tier to the red tier will remain at 10 per 100,000 people, but the threshold will change for moving to the orange tier, from 4 new cases per 100,0000 residents to 6 cases per 100,000 people, and to move to the yellow tier, the threshold will change from 1 new case per 100,000 residents to 2 cases per 100,000 people.

The table below lists the current tier for each county as well as any applicable additional restrictions, based on county Health Officer Orders.

Per the County’s July 1, 2020 Health Order, employers with 3 or more cases of COVID-19 “among their employees within a span of 14 days” must report this information to the County Department of Public Health.

  • Museum, Zoos and Aquariums can open indoors at 25% capacity.
  • Gyms, Fitness Centers, Yoga and Dance Studios can open indoors at 10% capacity with masking requirement for all indoor activities.
  • Movie Theatres can open indoors at 25% capacity with reserved seating only where each group is seated with at least 6 feet of distance in all directions between any other groups.
  • Retail and Personal Care Services can increase capacity to 50% with masking required at all times and for all services.
  • Restaurants can open indoors at 25% max capacity under the following conditions:
    • 8 feet distancing between tables; one household per table with a limit of 6 people;
    • the HVAC system is in good working order and has been evaluated, and to the maximum extent possible ventilation has been increased.
    • Public Health strongly recommends that all restaurant employees interacting with customers indoors are provided with additional masking protection (above the currently required face shield over face masks); this can be fit tested N95 masks, KN95 masks, or double masks and a face shield. In addition, Public Health strongly recommends that all employees working indoors are informed about and offered opportunities to be vaccinated. Outdoor dining can accommodate up to six people per table from 3 different households.
  • Indoor Shopping Malls can increase capacity to 50% with common areas remaining closed; food courts can open at 25% capacity adhering to the restaurant guidance for indoor dining.
  • Institutes of Higher Education can re-open all permitted activities with required safety modifications except for residential housing which remains under current restrictions for the Spring semester.
  • Schools are permitted to re-open for in-person instruction for students in grades TK-12 adhering to all state and county directives.
  • Private Gatherings can occur indoors with up to 3 separate households, with masking and distancing required at all times. People who are fully vaccinated can gather in small numbers indoors with other people who are fully vaccinated without required masking and distancing.
  • Breweries, Wineries and Craft Distilleries that do not provide a meal may open for outdoor service only with certain restrictions, including:
    • All guests must have reservations;
    • Guests are limited to a 90-minute time limit for their visit;
    • Guests must be seated at tables before they place their order, and are not permitted to stand or congregate with others;
    • And hours are limited with service for on-site consumption closing by 8:00 pm.
  • Breweries, Wineries, and Craft Distilleries that serve a bona fide meal can be open for indoor dining operations at 25% of indoor capacity and must follow the same modifications required of restaurants.
  • “Limited services businesses” (such as dry cleaners and non-school educational and tutoring facilities) indoors at 50% capacity
  • Mental Health, Support, and Counseling Services at 12 people maximum
  • Office-Based Worksites indoors for essential operations which cannot be performed remotely at 50% capacity
  • Youth and Adult Recreational Sports in line with state guidance, including: indoor training and conditioning, contact practices, and competition with adherence to state rules
